What is Personal Information?
“Personal information” is any piece of information about an identifiable individual. Personal information does include but not limited to name, title, address (personal & business), email (personal & business), URL (personal & business), associations(personal & business), birthday or telephone number (personal & business).
The terms “we”, “us” and “our” means Ginko, www.ginko.mobi and its owner as designated herein. “You” and “your” means the individual who is a customer (by virtue of viewing our materials or using our online services and/or our mobile application), employee or independent contractor of the company who owns and operates this web site.
What Information is Collected?
We collect three kinds of information from our mobile app and website:
(1) your voluntarily provided Personal Information, content and files;
(2) anonymous information about your visit; and,
(3) "cookie" based information to help us track which pages on our websites you're most interested in.
During normal mobile app and website usage, you can visit our mobile app or website without communicating any personal information. However, to make use of certain features on our mobile app and website, such as the Ginko Me, Address Book, Contact Builder, Chat, advertisements, promotions, personalized services or paid subscriptions, users will be asked to register with us.
As part of this voluntary registration, we may request contact information (such as name, mailing address, email address, etc.) and other data required for operating these services. We may only collect personal information from you if you voluntarily provide it. By voluntarily providing this personal information to us, by populating data fields, by sending us a comment, suggestion or feedback, by entering a chatroom, blog or bulletin board, or by entering a contest or promotion that is posted on our site, you will be consenting to the collection, use and distribution of your personal information by us for the purposes set out herein. You have control over what you share, and you can update information at any time. You are under no obligation to provide us with personal information to browse the public areas of our website, and you may access and enjoy parts of our website without providing us any personal information.
Maintaining your trust is our top concern, so we adhere to the following principles to protect your privacy:
1. We do not rent, sell, or otherwise provide your personally identifiable information to third parties for marketing purposes.
2. We do not share any information you have not chosen to display to other users, unless compelled by law, or as necessary to enforce our User Agreement or protect the rights, property, or personal safety of Ginko, its Users, and the public.

When you visit our mobile app or website, information about your visit (e.g. how you navigate) may be collected and stored. This information may include the length of your visit, the date and time of your visit, the pages you look at and the screens or pages you visit before and after leaving our site or mobile app. It does not include personally identifiable information such as your name, mailing or email address or telephone number. We use this non-identifiable and aggregate information to better design our mobile app and website. We also may share this information with our affiliates, suppliers, sponsors and advertisers. To tailor our site to the needs and interests of our visitors, we keep track of the pages visited by our users by placing a small entry-in text file, called a "cookie", on your hard drive. A cookie is transferred to your browser by a web server and can only be read by the server that gave it to you. Cookies do not reveal personal information. The only personal information a cookie can contain is information you supply yourself such as passwords, purchases and preferences. Cookies cannot read data from your hard drive.
You may visit the site with your cookies turned off. However, you may not be able to access some of the areas of our site, which require cookies for customization and personalization.
This mobile app or website is not lawfully accessible to persons under the age of 18 or who are otherwise covered by the provisions of the Child Online Privacy Protection Act of 1998 (COPPA). We will not knowingly encourage any minor to register with our site or to access those features which require registration, nor will we knowingly collect any personal information from children under the age of 13. If a child has provided us with personal information, we ask that any concerned parent or guardian of the child contact us, and we will delete the child’s personally identifiable information to the extent technologically possible. Fraudulent use of this mobile app and website may subject you to civil or criminal sanctions.
As a function of our fulfilling certain legal requirements, we may disclose Personal Information without consent.
We will retain Personal Information only as long as is required for the purposes we describe and as is required under law. Once Personal Information is no longer required (or if you have opted-out or withdrawn your consent), it is our practice that it is destroyed, deleted or made anonymous.
All decisions we make involving Personal Information are based on accurate, complete and up-to-date information. We rely on you, however, to disclose all material information and to inform us of any relevant changes or corrections as they may relate to you. We encourage you to contact us as soon as possible, and we will make the appropriate reasonable corrections or amendments, upon receipt of appropriate evidence.
We will protect Personal Information with appropriate safeguards and security measures. We utilize a combination of physical, administrative and electronic measures to ensure Personal Information is adequately protected on a day-to-day basis, for storage and disposal.
If you send us an email message that includes Personal Information, we will use that information to respond to your inquiry. Please note that email is not necessarily secure against interception.
You have a right to access, modify, correct and eliminate the data you supplied to Ginko. If you update any of your information, we may keep a copy of the information that you originally provided to us in our archives for uses documented in this policy. You may request deletion of your information at any time by contacting Ginko customer service. We will respond to your request within 30 days.
All of your email credentials provided to the “Contact Builder” or “Contact Importer” are securely processed and never stored by Ginko. We only access the email addresses of your contacts to manage your contacts. You may delete your email account from the “Contact Builder” at any time. By doing so, it will inactive the “Contact Builder” and you may not receive the full benefit of being a Ginko user.
We may also disclose your personal information and other information you provide to another third party as part of a reorganization or a sale of the assets of Ginko LLC, a subsidiary or division. Any third party to which Ginko transfers or sells Ginko’s assets will have the right to continue to use the personal and other information that you provide to us.
You can review the personal information you provided to us and make any desired changes to the information you publish, or to the settings for your Ginko account including your email and contact preferences, at any time by logging in to your account on the Ginko mobile applicaton. Please be aware that even after your request for a change is processed, Ginko may, for a time, retain residual information about you in its backup and/or archival copies of its database.
Please note that by becoming a User, you have given us your express and informed consent to transfer the data that you provide to us to the United States and to process it in the United States.
In addition, to protect any data you store on our servers, Ginko also regularly audits its system for possible vulnerabilities and attacks, and we use a tier-one secured-access data center. Since the Internet is not a 100% secure environment, we cannot ensure or warrant the security of any information you transmit to Ginko. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. Please note that emails, instant messaging, and other means of communication with other Users of Ginko are not encrypted, and we strongly advise you not to communicate any confidential information through these means.
California Privacy Rights. Beginning on January 1, 2005, California Civil Code Section 1798.83 permits our customers who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
